Information on trading smartnumbers®

Rights of use (ROU) in relation to a particular smartnumber® may be traded. The rights of use may only be traded in full, and holders are not permitted to trade partial rights of use.

A person who obtains a smartnumber® as a result of a trade must ensure that the rights of use register is updated with their details. Each time the rights of use holder changes any details in the register, a new rights of use PIN will be automatically sent via email to the current rights of use holder.

smartnumbers® obtained via the smartnumbers® system may be traded regardless of whether there is an active service in place for that number. However, a smartnumber® may only be retained by the rights of use holder if it has been placed into service during the previous three years. If the smartnumber® acquired via a trade is not in active service at the time of transfer, it is important to ascertain how long the number has been without an active service and, consequently, how much time is left to activate a service on the number before the rights of use will be cancelled.

For example, if the smartnumber® acquired via a trade has not been in active service for two years at the time of transfer, the new rights of use holder has one year to activate it into service before the rights of use are cancelled.

Public

When trading a smartnumber® to a new entity, both the current and proposed rights of use holders must complete the trade of rights of use form. Please note, there are two versions of the form:

The form must be completed by the parties to the trade and should be retained as evidence of the trade. It should not be lodged with ACMA.

Charities

There are restrictions on the ability of charities to trade smartnumbers®. A charity can only trade or license the rights of use for a smartnumber® acquired under the charities allocation process to another eligible charity. The receiving charity must also demonstrate a strategic link to the number. A number is strategic for an eligible charity if the number forms a word that:

  • matches a word that is part of the name of the eligible charity; or
  • matches a word within a registered trade mark or a registered business name of the eligible charity (the registered trademark and/or business name must be registered for at least 12 months or in use by the charity); or
  • is an acronym that comprises the initial letters of words within the name of the eligible charity, or words within a registered trade mark or a registered business name of the eligible charity; or
  • reflects the objects of the eligible charity as described in its constituting documents; or
  • matches a word within a common usage version of the eligible charity's name.

To ensure the validity of a smartnumbers® trade, ACMA advises receiving charities to complete the following form, and send to ACMA for appraisal

Once ACMA has confirmed the eligibility of the receiving charity, the following form should be completed. This form does not need to be submitted to ACMA.
